States could, in theory, try to keep Mr. Trump off the ballot by passing legislation requiring a clean criminal record, but this would be on legally shaky ground. By imposing speech codes that ban what they deem offensive speech without clearly defining it, they have encouraged illiberalism in an environment designed to cultivate the liberal arts. A conservative nonprofit said it organized the truck featuring the virtual billboards with students’ names and images under a banner that reads: “Harvard’s Leading Antisemites.”Palestinian human rights activists say doxxing is nothing new. They told CNN they’ve feared losing jobs and endured psychological harm for advocating for fair treatment of Palestinians under occupation – or for simply being Palestinian themselves. Doxxing is the release of personal information without a person’s consent, often with malicious intent, according to the International Encyclopedia of Gender, Media, and Communication. Despite the reality of harassment for Palestinian Americans, the student said, the current sense of hysteria on the Harvard campus is unprecedented.

Last month, when the Senate Judiciary Committee held a hearing on whether to impose an ethics code on the court, some of the Republican senators on the committee decried the effort as political. Liberals and conservatives should want a Supreme Court that is above reproach. Senators Sheldon Whitehouse and Richard Blumenthal, along with other Democrats, have introduced the Supreme Court Ethics, Recusal and Transparency Act. Among other things, it would require the Supreme Court to adopt a code of conduct within 180 days of the bill’s enactment. It also would create a transparent process for the public to submit ethics complaints against justices, to be reviewed by a random panel of chief judges.

Nevertheless, the slow pace at which rulings have been issued this term has started to attract scrutiny from court watchers. In both 2022 and 2021, the court had decided 25 cases by May 1, according to Feldman. Court experts differed on whether the crunch would have any impact on how the court actually decides cases.

Sotomayor, who has dissented in major cases including the abortion decision as the court's 6-3 conservative majority has become increasingly assertive, described herself as "shell-shocked" and "deeply sad" after that term ended in June. The court's current term, which began in October, could be just as consequential as its previous one. At Wednesday's conference, Chemerinsky noted that he had never before seen his law students so discouraged about the Supreme Court. Sotomayor, appointed to the court by Democratic former President Barack Obama in 2009, expressed optimism that the direction of the court will change in the future.
